PURCHASE AND SHIPPING CONDITIONS

1. SCOPE OF THE CONTRACT

These General Purchase Conditions apply to the sale of all Ruby Abalorio S.L. Through its website, to consumers to whom orders can be delivered in Europe (euro zone only). Ruby Abalorio S.L. informs that its website is directed exclusively to an audience over 18 years of age. Ruby Abalorio S.L. reserves the right to cancel a user’s access account if fraudulent, speculative or bad faith acts are detected in the use of this service.

2. PRICE

The applicable prices are those indicated on the website on the date of the order. The prices are detailed in each article without VAT. (Value Added Tax) applied. The total amount, together with the shipping costs, is indicated to the customer in a broken down manner at the time the order is placed.

3. PAYMENT

Payment will be made at the end of the purchase process. Accepted means of payment: Purchases can be paid with a Visa®, Mastercard® or American Express® credit card as well as with a 4B or 4B Maestro debit card (which implies an automatic charge) and PayPal system. In any case, the choice of the means of payment is made during the purchase process on the corresponding screen.

4. DELIVERY

The delivery period will be a maximum of 15 calendar days from the date of purchase. The delivery of the orders will be made at the address indicated by the client, taking into account the following characteristics:

5 HOME DELIVERY

The customer must pay the transport costs according to the weight and the delivery destination of the general order. Ruby Abalorio S.L. It will not be responsible for the customs expenses that may be generated with the order, the customer is the one who must pay these, which will vary depending on the value of the shipment. These expenses are paid at the time the order is received and in no case will they be included in the price paid for the products. The address indicated by the client may be a private address, a place of work or any other address indicated. The billing address and shipping address do not have to match.

5.1 PICK-UP IN STORE (ONLY VALENCIA)

The customer can pick up his order at the Manises store at Avda. De la Cova Nº35, 46940 Valencia, he will be notified when the order is available to pick it up. The customer will have a maximum period of 15 days, from the time their order is available, to collect it. In the event that after said period, the order has not been collected by the client, for reasons not attributable to our Company, we will understand that he decides to withdraw from the contract and we will consider it resolved. Consequently, we will refund the payments made without undue delay and, in any case, before 14 calendar days have elapsed from the date on which we consider the contract to be terminated. The refund will be made by the same means of payment with which it was paid.

5.2 INCIDENTS IN THE DELIVERY

In case of not being able to make the delivery due to the absence of the recipient, the transport agency will notify the recipient. After two unsuccessful attempts, the customer must contact the transport agency to proceed with the delivery.

6. CHANGES, RETURNS AND WITHDRAWAL

There are different procedures for making changes, returns and withdrawals and below we will describe the characteristics of each of them, as well as their conditions.

a) Change: the substitution for the same product in another color and or measure is considered change.

b) Return: originated by a defect or receipt of a wrong product.

c) Withdrawal: originated by the customer’s decision.

• All products to be exchanged or returned must be properly packaged, with the original packaging of the items.

6.1 ORDERS DELIVERED IN SPAIN (PENINSULA AND BALEARIC ISLANDS)

CHANGES made in physical store and online store

– Conditions: the exchange process must be carried out within 30 calendar days after receipt of the order.

– Cost: The client must pay the transport costs.

– Process:

    – In physical store: present the original ticket that you received with your order and the product to be exchanged.

    – In online store: get in touch with our Customer Service, calling 96 153 86 74 or via email rubydiyservice@gmail.com and we will pick up the product / s at the delivery address that you indicate if the customer is so he wants it.

RETURNS (for tare, defect or receipt of a wrong product) made in physical store and online store

– Conditions: the return process must be carried out within 30 calendar days after receipt of the order.

– Cost: returns have no cost for the customer. Ruby Abalorio S.L. will reimburse the corresponding amount (including the shipping costs of the initial delivery and customs expenses) without undue delay and, in any case, before 14 calendar days have elapsed from the date on which you have been informed of the return. The refund will be made by the same means of payment with which it was paid. However, we may withhold the refund until we have received the goods, or until you have provided proof of the return of the goods, depending on which condition is met first.

– Process:

    – In physical store: present the original receipt that you received with your order and the product to be returned.

    – In online store: contact our Customer Service, calling 96 153 86 74 we will pick up the product / s at the delivery address that you indicate. You must include, completed, the document attached to the shipment (Exchange, return and withdrawal form)

RIGHT OF WITHDRAWAL made in physical store and online store

– Conditions: you have the right to withdraw from the contract without the need for justification, within a period of 14 calendar days from receipt of the product.

– Cost:

    – In physical store: it has no cost for the customer. Ruby Abalorio S.L. will reimburse the corresponding amount without undue delay and, in any case, before 14 calendar days have elapsed from the date on which you have been informed of the withdrawal decision.

    – In the online store: the customer will be responsible for the shipping costs of the products to be returned, as well as the corresponding customs costs. Ruby Abalorio S.L. will reimburse the corresponding amount (The shipping costs of the initial delivery are not refundable, in the same way the customs costs) without undue delay and, in any case, before 14 calendar days have elapsed from the date on which it was informed of the withdrawal decision.

The refund will be made by the same means of payment with which it was paid. However, we may withhold the refund until we have received the goods, or until you have provided proof of the return of the goods, depending on which condition is met first.

– Process:

    – In physical store: present the original ticket that you received with your order and the product / s to be withdrawn.

   – In online store: send the products to Ruby Abalorio S.L. Avda. De la Cova Nº35, 46940 Manises, Spain, by the means of transport you choose and paying you customs expenses.

7. AVAILABILITY OF THE PRODUCTS

If there are incidents regarding its supply or if there are no products in stock, the customer will be informed immediately and the amount of the product or products without stock will be reimbursed. Ruby Abalorio S.L. will refund the corresponding amount without undue delay and, in any case, before 14 calendar days have elapsed. The refund will be made by the same means of payment with which it was paid.

These General Purchase Conditions are subject to Spanish legislation. The parties submit, at their choice, for the resolution of conflicts and renouncing any other jurisdiction, to the courts and tribunals of the client’s domicile.
